Service terms and policies
These are the standard service terms that apply to every project and plan Eski Media delivers: websites, e-commerce, SEO, Google and Meta ads, social media, photo, video and drone work, email marketing, custom software and AI automation. We wrote them in plain language so you know what to expect before you pay anything.

1. How these terms work
Two documents set the terms for any job we do for you:
- Your written quote or agreement. It names the service, price, deliverables and timeline for your project.
- These service terms. They cover everything the quote doesn’t spell out.
If the two ever disagree, your quote or agreement wins. Accepting a quote, paying a deposit or booking a shoot means you accept these terms. Our general terms of use cover the website itself, and our privacy policy covers personal information.
Our services are built for businesses and organizations. If you hire us as an individual consumer, Nova Scotia’s consumer protection laws may give you rights these terms can’t take away. Where that’s the case, those rights apply.
2. Quotes, scope and timelines
- Quotes are valid for 30 days from the date we send them, unless the quote says otherwise.
- Website prices are a starting point. Package prices on our site describe a typical project. Your quote reflects your actual scope.
- Scope is what’s written. Anything not listed in the quote, such as extra pages, features, products, languages, shoot hours or edits, counts as additional work. We’ll quote it before we do it.
- Timelines depend on both of us. Our timelines assume you send content, feedback and approvals when the schedule needs them. If you need more time, the delivery date moves by at least the same amount.
- All prices are in Canadian dollars and exclude HST, which we add at the rate that applies to you.
3. Payment
| Service type | Standard payment terms |
|---|---|
| Website, e-commerce and software projects | 50% deposit to book the project, balance due before launch or handover of files |
| Photo, video and drone shoots | 50% deposit to hold the date, balance due on delivery, before full-resolution files are released |
| Monthly plans (SEO, ads management, social media, care plans) | Billed monthly in advance |
| Smaller fixed-price jobs under $300 | Payment in full when booking |
- Invoices are due within 14 days unless the invoice says otherwise.
- Late payment. If an invoice is more than 14 days overdue, we may pause work, ad management and support until it’s paid. We’ll tell you in writing before we pause anything. Overdue amounts may carry interest of 2% per month (26.82% per year). Canada’s Interest Act requires the yearly rate to be stated.
- Files and access follow payment. We hand over final files, source code, admin access transfers and copyright licences once the related invoice is paid in full.
- Third-party costs are yours. Domains, hosting, premium themes and plugins, fonts, stock media, email platforms, AI usage, software subscriptions and advertising spend are billed to you, directly where possible. If we buy something on your behalf, we’ll invoice it at cost with your approval.
4. Your responsibilities
Good results need a few things only you can provide:
- Content and accuracy. You provide or approve all text, prices, claims, product details and contact information. You’re responsible for making sure they’re accurate and lawful, including any health, financial, legal or comparative claims in your ads and pages.
- Rights to materials. When you send us logos, photos, video, music, fonts, text or customer lists, you confirm that you own them or have permission to use them. If a third party makes a claim about material you supplied, you agree to cover the resulting costs.
- Timely feedback. One person on your side should be able to approve work. If we don’t hear from you for 30 days during a project, we may put it on hold. Restarting may need a new schedule and, for long pauses, an updated quote.
- Access. Logins or partner access to your domain, hosting, Google, Meta and other accounts when the work needs them. Never send passwords by plain email. We’ll show you safer ways to give access.
- Industry rules. If your business is regulated, for example in real estate, health care, finance or law, you’re responsible for checking that your marketing meets your regulator’s rules. We’ll follow your instructions and flag anything we notice.
- Backups of your own data outside any system we maintain, such as copies of your customer lists and important documents.
5. Revisions and change requests
- Design and website projects include two rounds of revisions at each design stage, unless your quote says otherwise. A round is one consolidated list of changes, sent together.
- Edited video includes one round of revisions per video. Edited photos include reasonable colour and crop adjustments.
- Change requests after approval, or beyond the included rounds, are quoted separately or billed at our hourly rate, which we confirm in writing first. We always tell you before extra charges start.
- A change of direction, such as a new brand, a different layout concept or a new set of pages, counts as new scope, not a revision.
- Approvals are final. Once you approve a design, a draft or a post, we treat it as final. Later changes are change requests.
6. Ownership and licences
| Deliverable | What you get on full payment |
|---|---|
| Website design and custom code we write for you | Ownership of the finished design and custom code |
| Logos and brand assets | Ownership of the final approved logo and brand files. Unused concepts stay with us |
| Written content we create for you | Ownership of the final approved text |
| Photos and video | A permanent, non-exclusive licence to use the final edited files to market your business, in any medium, in Canada and worldwide. We keep the copyright |
| Raw footage and unedited files | Not included, except where the service is sold as raw delivery (for example, our drone-only shoot) |
| Ad accounts, analytics, pixels and audiences | They’re yours, set up in your business accounts |
Why we keep copyright in photos and video. Since 2012, Canadian copyright law has generally made the photographer, not the person who commissions the photos, the first owner of copyright. Our licence gives you everything a business normally needs: your website, social media, ads, print and listings. You can’t resell the files, license them to others, or enter them in competitions as your own work. If you need full copyright assignment, for example for a product launch or a merger, ask us and we’ll quote it.
Things nobody owns outright. Themes, plugins, fonts, stock media, software libraries and platforms belong to their makers and come with their own licences. We also keep our own pre-existing tools, code libraries, templates and know-how. We can reuse them on other projects, without your content or branding.
Real estate. Listing photos are licensed to the listing agent or brokerage that books them, for marketing that property. Using them for a different listing, or passing them to another agent, needs our permission.
7. Websites, hosting and maintenance
- Domains in your name. We register or move domains into your name or business name, so you always control them.
- Browser and device support. We build for current versions of major browsers, on phones, tablets and desktops. We don’t support outdated browsers.
- Launch. A site is complete when it goes live or when you approve it for launch, whichever comes first. Requests after that are maintenance or new work.
- Bug fixes. We fix errors in our own work reported within 30 days of launch at no charge. That doesn’t cover problems caused by later edits, plugin or platform updates, or hosting changes we don’t manage.
- Hosting and care plans run month to month unless your quote sets a term. Either side can end one with 30 days’ written notice. When a plan ends, we give you a full backup of your site files and database. We delete our copies after 60 days.
- Third-party platforms. We aren’t responsible for outages, price changes, security breaches or feature changes at hosting companies, Shopify, WordPress, plugin makers or payment processors. We’ll help you respond when they happen.
- Accessibility and legal pages. We follow good accessibility practice in our designs. You’re responsible for your own legal pages, like privacy policies and store terms, and for any legal accessibility obligations that apply to your business.
8. SEO, Google Ads, Meta ads and social media
No guaranteed rankings or results
Google itself warns that “no one can guarantee a #1 ranking on Google” (Google Search Central). Search results, ad auctions and social algorithms are controlled by Google and Meta, and they change often. We promise the work described in your plan, done carefully and reported honestly. We don’t promise specific rankings, traffic, leads, sales or return on ad spend. Results and timelines on our site and in our proposals are examples, not guarantees.
Advertising spend
- You pay ad spend directly to Google, Meta or the platform, on your own payment method, in your own account. Our management fee is separate.
- Ad spend already delivered by a platform can’t be refunded by us.
- Budgets you approve are maximums we work within. Platforms can sometimes spend a little more on a given day, within their own rules.
Platform policies and account decisions
- Google and Meta can reject ads, limit targeting, or suspend accounts and profiles. Special ad categories such as housing, employment and financial services come with mandatory targeting limits.
- We follow platform policies and help you appeal. We can’t control or guarantee platform decisions, and we’re not responsible for losses caused by them.
- You’re responsible for the truth of your offers and claims, and for any licences your industry requires to advertise.
Monthly plans
- Monthly plans have a minimum term of 3 months unless your quote says otherwise. SEO and ad accounts need time to learn and show results.
- After the minimum term, either side can cancel with 30 days’ written notice. Fees for the notice period are payable.
- When a plan ends, you keep everything in your accounts. We remove our access when you ask, and we’ll hand over reports and any documents we created.
- Social posts we draft are published only after you approve them, unless you’ve told us in writing that we can post within agreed topics.
More detail in our SEO, Google Ads and Meta ads pages.
9. Photo, video and drone shoots
Booking and rescheduling
- Your date is reserved once we receive the deposit.
- You can reschedule for free with at least 48 hours’ notice. Later changes may lose the deposit.
- If you’re not ready when we arrive, the shoot time still counts from the booked start time. If we can’t shoot at all because the location isn’t ready or accessible, it counts as a late cancellation.
- If we have to reschedule because of illness or an emergency on our side, we’ll offer the next available date or a full refund of what you’ve paid.
Weather, airspace and safety for drone flights
- All drone flights follow Transport Canada’s Canadian Aviation Regulations. Our pilot holds a Transport Canada Advanced Operations certificate.
- The pilot has the final say. We can delay, shorten, move or cancel a flight if wind, rain, snow, fog, cold, light, nearby people, aircraft or other conditions make it unsafe or unlawful. Safety decisions aren’t open to negotiation on the day.
- Weather and safety reschedules are free. If we cancel a flight for weather or safety, we rebook at no extra charge. We don’t refund the deposit for weather alone. It carries over to the new date.
- Airspace. Some sites need permission from NAV CANADA or another authority. Approval times aren’t in our control, and some locations, such as near military aerodromes, may need longer notice or may not be possible. If permission is refused, we’ll offer ground-level coverage, another date or a refund of the drone portion.
- Permission to fly from your property. You confirm that you’re allowed to have us take off from, land on and photograph the property you book us for, or that you’ve arranged permission from the owner.
People, property and privacy
- If people can be identified in footage you plan to use in ads, you’re responsible for getting their permission. That includes your staff, customers and guests. We can provide a simple release form.
- We avoid capturing neighbours’ private spaces and will blur or remove identifiable people, licence plates or house numbers when you ask, or when we think it’s needed.
Delivery
- Delivery times start the day after the shoot and are listed in your package. The $349 On-Site Shoot delivers in five business days.
- We deliver through an online link. Download your files promptly. We keep delivered files for 90 days, but long-term storage is your responsibility.
- Editing style is part of our work. We’ll match the style you approve from our samples or your brief. Requests for a completely different style count as new work.
10. Email marketing, custom software and AI
Email marketing
- You confirm that every contact list you give us was collected with consent that meets Canada’s Anti-Spam Legislation (CASL). We won’t send to purchased or scraped lists.
- Every campaign we send includes your identification and a working unsubscribe link. You agree not to re-add people who’ve unsubscribed.
- CASL penalties fall on the sender. As the business sending the messages, you’re responsible for your consent records. See email marketing.
Custom software and integrations
- We build to the written scope and test before handover. Software can still contain bugs. We fix defects in our own code reported within 30 days of handover at no charge. After that, fixes fall under a support plan or our hourly rate.
- Integrations depend on other companies’ APIs. If a provider changes or retires its API, the updates are new work.
- If the system handles personal information, you are the organization responsible for it under Canadian privacy law. We design the system to collect only what’s needed and protect it.
AI-assisted work
- We use AI tools in some of our work, such as drafts, image generation, sorting and summaries, always with human review on our side.
- AI output can be wrong. For automations and chatbots we build for you, you approve what the system may say or do. You stay responsible for decisions and statements made in your business’s name, including by a chatbot on your website.
- We don’t put your confidential or personal data into AI tools beyond what the task needs, and we prefer providers and settings that don’t train on business data.
11. Cancellations and refunds
| Situation | What happens |
|---|---|
| You cancel a project before work starts | Deposit refunded minus any third-party costs already paid on your behalf |
| You cancel a project after work starts | You pay for the work done to date, at our hourly rate or the matching share of the quote, whichever is lower. The deposit applies to that amount. We hand over the work completed once paid |
| You cancel a shoot with at least 48 hours’ notice | Free reschedule, or a refund minus any third-party costs already paid |
| You cancel a shoot with less notice | Deposit kept |
| Weather or safety cancellation by our pilot | Free reschedule, with the deposit carried over |
| Monthly plan | Cancel with 30 days’ written notice after the minimum term. No refunds for partial months |
| We cancel for reasons on our side | Full refund of anything paid for work not delivered |
If you’re unhappy with delivered work, tell us within 14 days of delivery. We’ll fix anything that doesn’t match the agreed scope. We don’t refund work for reasons of taste once you’ve approved it.
We can end a project too, with written notice, if invoices go unpaid, if you ask us to do something unlawful or against platform rules, or if anyone on the project is abusive to our team. You’ll pay for work completed to that date.
12. Limits of liability
- We do our work with care and skill. If something goes wrong because of our mistake, we’ll put it right as quickly as we can.
- Our total liability for any claim connected to a project or plan is limited to the fees you paid us for that project, or for the three months of a monthly plan before the claim arose.
- We’re not liable for indirect or consequential losses, such as lost profits, lost data, lost opportunities, or damage to reputation.
- We’re not responsible for delays or failures caused by things outside our reasonable control. That includes outages at hosting, platform or software providers, platform policy decisions, cyberattacks on third-party systems, power or internet failures, severe weather, and government restrictions.
- Nothing in these terms limits liability that can’t legally be limited.
13. Confidentiality and privacy
- We keep your business information, logins, reports and customer data confidential and only use them to do the work you hired us for.
- Logins are stored securely and removed when we no longer need them. We recommend you change shared passwords when a project ends.
- We handle personal information as described in our privacy policy.
14. Portfolio and case studies
We may show completed work, such as screenshots, photos and short video clips, in our portfolio and social media, and name you as the client. If you’d rather we didn’t, tell us before the project starts or at any time after. We’ll keep it private. We never publish your results, numbers or confidential details without your written permission.
15. Disputes, governing law and changes
- Talk to us first. Most problems are solved with one honest conversation. Email us and we’ll reply within two business days.
- Governing law. These terms are governed by the laws of Nova Scotia and the federal laws of Canada that apply there. Disputes go to the courts of Nova Scotia. Smaller claims may go to the Small Claims Court of Nova Scotia.
- Changes. We may update these terms. The version in effect when you accept a quote applies to that project. For monthly plans, changes apply from the next billing period after we tell you.
- If one part doesn’t hold. If a court finds any part of these terms unenforceable, the rest still applies.
Questions about these terms?
Ask before you sign. That’s always the best time. We’re happy to explain any section or adjust it for your project in writing.
